This gift, described as potentially the most valuable ever extended to the U.S. from a foreign government, is expected to be available for President Donald Trump during his second term and later transferred to his presidential library foundation. Sources familiar with the arrangement revealed this development to ABC News. The official announcement of this gift is anticipated during President Trump's visit to Qatar, marking his first foreign trip of his second term. The plane, often referred to as "a flying palace" due to its opulent design, was previously toured by Trump at the West Palm Beach International Airport in February. This unusual arrangement has sparked legal and ethical questions regarding the acceptance of such a significant gift from a foreign power. In response, legal teams from the White House Counsel's Office and the Department of Justice have crafted an analysis for Defense Secretary Pete Hegseth. They concluded that it is permissible for the Department of Defense to accept the aircraft and subsequently transfer it to the Trump library, ensuring it does not violate bribery laws or the U.S. Constitution's emoluments clause, which prohibits government officials from receiving gifts from foreign states. Attorney General Pam Bondi and Trump's top White House lawyer, David Warrington, confirmed the legality of the donation, provided it includes the condition of transferring ownership to Trump's presidential library before his term ends. Bondi drafted a legal memorandum for the White House Counsel's Office, following Warrington's request for advice on the Pentagon's acceptance of the donation. Neither the White House nor the Department of Justice has responded to requests for comment. Additionally, a spokesperson for the Qatari embassy did not reply to ABC's inquiries. Initially, the plane will be handed over to the United States Air Force, which will modify the 13-year-old aircraft to meet U.S. military specifications for presidential transport. The aircraft is valued at approximately $400 million, excluding the additional communication and security upgrades necessary for safely transporting the president. Aviation company L3Harris has been contracted to refurbish the plane to meet presidential jet standards. The White House and DOJ determined that since the gift is not linked to any official act, it does not constitute bribery. Bondi's legal analysis further clarifies that the donation does not breach the constitutional prohibition on foreign gifts because it is being given to the United States Air Force and, eventually, the presidential library foundation, rather than to an individual. Currently, the primary Air Force One fleet comprises two aging Boeing 747-200 jets, operational since 1990. Boeing's contract to replace these aircraft has faced numerous delays and cost overruns. Initially signed in 2018, the contract projected the new aircraft would not be ready until 2029, post-Trump's presidency. Expressing frustration over these delays, President Trump enlisted Elon Musk to collaborate with Boeing and the Air Force to expedite the process. While these efforts have seen some success, Boeing's latest estimated delivery date has been moved up to 2027. However, Trump has emphasized his desire for a new plane this year. This development in presidential aviation marks a significant shift in the longstanding tradition of Air Force One operations, with potential implications for the legal and diplomatic landscape of government gifts and foreign relations.
